The inheritance rights of foreigners are protected in Turkey. In the event of the death of a foreign property owner, the immovable or immovables acquired by the foreigner are transferred to the name of the heirs following their application to the relevant Turkish authorities. In order for this to happen, a transfer case must be filed in Turkish Courts. Attorneys registered with Turkish Bar Associations, to be appointed by the heirs with a power of attorney, submit to the court documents that will constitute evidence such as birth, death, marriage, divorce and inheritance documents of the deceased owner and his heirs, and their official translations, to the court, and the transfer of the real estate to the legal heirs of the deceased foreign national. They will issue the necessary certificate of succession. Based on this certificate of inheritance, the relevant land registry directorates transfer the immovable property to the name of the legal heirs.
Official spouse and children are natural heirs of a person. In case of death, the real estate subject to inheritance is transferred to the spouses and children who are the legal heirs, and if not, to their parents, siblings, grandparents and grandchildren, respectively, according to the rates to be determined in the certificate of inheritance.
